I am able to counsel clients on the form of authorization that makes the most sense for their situation and, offer alternatives where available. I can also assist with Federal Operating Permits and other federal requirements such as NSPS and NESHAPS, Non-attainment and PSD permitting.

Texas Environmental, Health, and Safety Audit Privilege Act. What is it?
AT LAW PLLC helps clients with privileged audits under the Texas Audit Privilege Act. Companies may be able to obtain two important benefits as part of a voluntary, environmental self-audit. Under certain circumstances, the company may obtain a limited evidentiary privilege for information gathered during the self-audit. In addition, voluntary disclosure under the Audit Act can provide immunity from certain administrative and civil penalties. Thus, depending on your situation, the Audit Privilege Act might create incentives for you to conduct a voluntary audit. However, before undertaking the self-audit it is important to understand the framework of the Act in order to take advantage of its benefits and, importantly, not create undue exposure to liability.
Enforcement actions for environmental violations typically arise when a violation is discovered during a site inspection. The inspecting agency might issue a Notice of Violation (NOV) or, if the violation is more serious, they can issue a Notice of Enforcement (NOE).
AT LAW PLLC can assist clients in handling and negotiating these enforcement actions, either through Agreed Orders in the administrative process or, in court proceedings involving civil or criminal enforcement actions.
